We invite you to read carefully the following provisions as they present the general conditions of donations for Afrika-Maroc, an association recognized as being of public utility.

The “click” that you will execute after having filled the donation form constitutes the validation of your donation and will be worth irrevocable acceptance of the present general conditions.

Consequently, you can only make a donation if you accept the following conditions.

1. Introduction

The following terms and conditions of donation govern all transactions made on the Afrika-Maroc Association’s website. Any donation made on this website implies the donor’s unconditional and irrevocable acceptance of these terms and conditions.

The Afrika-Maroc Association is a non-profit association with a non-political purpose governed by the dahir n° L58.376 of 3 Joumada I 1378 (15 November 1958).

2. Subject

The present contract is a distance contract whose purpose is to define the rights and obligations of the parties within the framework of Internet donations for the Association Afrika-Maroc through the platform Centre Monétaire Interbancaire.

www.zawyaty.com is a service and a trademark registered by the Association Afrika-Maroc. Center Monétaire Interbancaire is a transaction management service and a trademark registered by Centre Monétaire Interbancaire S.A.

The provisions of the present statutes are subject to the dahir n° L58.376 of 3 Joumada I 1378 (November 15, 1958) regulating the right of association, modified and completed by the dahir n° 1.73.283 of Rabii 11393 (April 10, 1973), as well as to the provisions of the law n° 75.00 promulgated by the dahir n° 1.02.206 of 12 Joumada I 1423 (July 23, 2002)

3. Definitions

In the remainder of the contract, each of the expressions mentioned above shall be understood in the sense of its definition, namely:

– “Remote Contract”: any contract concerning donations between the Afrika-Maroc Association and a Donor within the framework of a remote donation system organized by the Afrika-Maroc Association which, for this contract, exclusively uses the Internet network until the conclusion of the contract, including the conclusion of the contract itself.

– Donor”: any natural person who, in the present contract, acts for personal purposes.

– Donation Form”: a document that indicates the characteristics of the donation made by the Donor and that must be confirmed by “clicking” to commit him/her.

– Donation ” : act by which the Donor commits to make a donation and the Afrika-Maroc Association to receive it.

4. Making a donation

After choosing the amount of the donation you wish to make, the amount is automatically added to your donation form. When you have finished, validate your donation by clicking on the “Send” button.

Once validated, your donation is not refundable but can be accounted for.

5. Donation allocation

When your donation is made during a specific fundraising campaign, your donation is automatically allocated to the project in question. Outside of a fundraising campaign, the Afrika-Maroc Association can inform you of the project to which your donation has been allocated following a request from you sent to president@zawyaty.com

The Afrika-Maroc Association is not required to provide a financial report to the donor.

6. Payment Method

To make your donation by credit card, you choose the method of payment among those proposed by the Association Afrika-Maroc (Visa, MasterCard, Maestro, cmi). Your account will be debited the day following the date of confirmation of the transaction.

Your credit card payment is secured by the Centre Monétaire Interbancaire which offers a fully secured payment service.

The Donor guarantees to the Afrika-Maroc Association that he/she has the necessary funds and authorizations to use the method of payment chosen by him/her, when validating the donation form.

In case of payment by credit card, the provisions concerning the fraudulent use of the means of payment provided for in the agreements concluded between the Donor and the issuer of the card, between the Association Afrika-Maroc and its banking institution, shall apply.

7. Data confidentiality 

The information you are asked to provide is necessary for the processing of your donation and is treated confidentially. You have the right to rectify any data concerning you. You may receive thanks and newsletters from Afrika-Maroc. If you do not wish to receive these, please inform us at the following address: president@zawyaty.com 

The clauses of the present contract are subject to the Dahir n°1.09.15 of 22 safar 1430 (18 February 2009) promulgating the law n°09.08 relating to the protection of individuals with regard to the processing of personal data. 

8. Proof of transactions paid by credit card 

The data recorded by Centre Monétaire Interbancaire S.A on the platform Centre Monétaire Interbancaire on behalf of Association Afrika-Maroc constitute the proof of all the commercial transactions passed between you and Association Afrika-Maroc in accordance with the Law n° 53- 05 relating to the electronic exchange of legal data of the Dahir n° 1-07-129 of 19 kaada 1428 (30 November 2007) promulgating the law n° 53-05 relating to the electronic exchange of legal data. 

9. Communication 

For individuals, donations exceeding 25 000 DH may be the object of an official communication from the Afrika-Maroc Association following a request from the donor communicated to the address president@zawyaty.com. 

10. Final Provisions 

When you make a donation online, you do have the right to visit any of our schools or training centers.
